Policy
Skax LLC ("Skax"
or "we") is dedicated to establishing trusting relationships with its
users, based on respect for personal identity and information, by promoting the
use of fair information practices. This privacy statement covers all software
released and Web properties owned and maintained by Skax
LLC, including but not limited to www.skax.net.
Because we want to demonstrate our commitment to our users' privacy, we are
disclosing:
- What personally identifiable
information Skax collects.
- How Skax
uses the information.
- With whom Skax may share this information.
- What choices are available
to users regarding collection, use and distribution of the information.
- What types of security
procedures are in place to protect the loss, misuse or alteration of this
information to the extent under Skax control.
- How users can correct any
inaccuracies in the information.
Information
Collection and Use
Information Collection
Skax is the sole owner of the information collected
on its web properties, including www.skax.net,
and through its software client. Skax collects
information from its users at several different points through form
submissions, Skype IM messages, and other client-server
interactions.
Form Submissions
During the credit purchase process through Paypal,
Google Checkout or other payment providers, we collect the user’s “Skype id” (aka. “Skype
username” or “Skype login”). This information
is collected for the sole purpose of identifying and crediting the specific
user account after purchasing Skax credits. From the
credit purchase, we derive other information such as payment transaction order numbers
that help us maintain proper accounting measures.
We do not collect any other
personal information such as phone numbers, passwords, social security numbers,
email addresses, payment instrument, billing addresses, or demographic
information.
Skype IM Messages
To maintaining appropriate security measures, we collect Skype
IM messages sent by the client during the course of using the Skax software client. These messages do not contain any
personal information and they are only used for security measures so that no
other users can impersonate the account holder. Information transmitted from
the Skax client to us includes:

Skype id: to allow us
to identify this user in the system to retrieve user balance and past fax
history information.

Session id: a randomly generated number based on
the time of the day, that allows us to securely identify
later requests from this user by checking against this session id.

Logout message: to help us know when the user
has log-out of the system and to prevent unauthorized use of the user’s balance
account.
Client-server interactions
A
number of client-server interactions occur during the normal course of
operation of the Skax client that communicates information
to the Skax server and which we record. This
information includes:

Skype id: to
properly identify this user. This is for specific requests including, but not
limited to, retrieving account balance and history information.

Session id: to prevent unauthorized access of the
user’s balance, previous fax history information, and to thwart malicious use
of the Skax software.

Fax information: this includes the actual fax to be
sent (and potentially cover letter information as well). The Skax client will send this information to us and we will
temporarily store the faxes while they are in the process of being sent. These
fax information is kept temporarily in our servers afterwards and they are
promptly removed from our systems. At no point in time do we access this fax
information without the user’s permission.
Communications from the Site
Skax LLC has a zero tolerance policy for abuse.
While we cannot be responsible for external communications received through Skax services, it is our intention to use all legally
available means to prevent distribution and receipt of unsolicited commercial
faxes ("junk faxes") through the service, and we specifically restrict
members from taking any actions which impose an unreasonable or
disproportionately large load on Skax resources. We
ask that any users who are annoyed by receipt of such
junk faxes, please report such activity to Customer Support here.
Sharing
We do not share information obtained from users except as otherwise
specifically set forth in this Privacy Policy.
Legal
Though we make every effort to preserve user privacy, we may need to
disclose personal information when required by law or where we have a
good-faith belief that such disclosure is necessary to comply with a current
judicial proceeding, a court order, legal process served on our Web site, or in
order to investigate, prevent, or take action regarding illegal activity. For
example, we may disclose personal information to law enforcement, other
government officials, or third parties in response to criminal or civil
subpoenas. Sometimes, these requests come from our third party Internet,
telecommunications and collocation providers all over the world who supply the
network required for us to deliver our services. In order to maintain the
integrity of our network, we often cooperate with requests from these third
party providers and/or requests from law enforcement or other governmental
officials directed to these providers.
Civil Subpoena Policy
Skax does not release personally
identifying information about our customers except in limited instances related
to law, security, or safety. To request customer information from Skax in a civil case, you must serve Skax
with a valid subpoena, court order, or search warrant and agree to Skax's terms of compensation below.

Upon receipt of a valid subpoena, it is Skax's
policy to notify the subscriber whose information is sought. In non-emergency
circumstances, Skax will generally not produce the
subpoenaed subscriber's identity information until approximately two weeks
after receipt of the subpoena, unless a formal
objection is filed by the customer or we are legally required to do so.
Skax charges $90.00 per hour for
research (plus additional fees if testimony or deposition is required), $0.25
per page, and $22.00 to respond via Federal Express. We will invoice the person
or entity submitting the subpoena following receipt and the subpoena proponent
must make payment within 15 days from the date of receipt of our invoice.

It is Skax's policy to release information
sufficient to identify our customer only where the party seeking the
information has filed a legal action that implicates our customer in some
legally cognizable impropriety or wrongdoing or can show that the information
requested is material to the issues involved in the underlying case. Skax requests a copy of the complaint and all supporting
documentation to indicate how the customer's account information is related to
the pending litigation. Note that Skax reserves the
right to determine in its sole discretion the applicability of this policy to
any particular request and, further, this policy does not create any
enforceable legal rights, either for our customers or for requesting parties.
Business Transitions
In the event Skax goes through a business
transition, such as a merger, being acquired by another company, or selling a
portion of its assets, users' personal information will, in most instances, be part of the assets transferred. Users will be notified
prior to a change of ownership or control of their personal information. If as
a result of the business transition, the users' personally identifiable
information will be used in a manner different from that stated at the time of
collection they will be given a choice not to have their information used in
this different manner, as described in the notification of changes section,
below.

Opt-out
Users are given the opportunity to
'opt-out' from having their information used for purposes not directly related
to our Web sites at the point where we ask for information..
Links
Skax's Web sites contain links to other sites.
Please be aware that Skax is not responsible for the
privacy practices of such other sites. We encourage our users to be aware when
they leave our sites and to read the privacy statements of each and every Web
site that collects personally identifiable information. This privacy statement
applies solely to information collected by Skax's Web
sites and software.
Security
Skax takes
every reasonable precaution to protect its user's information. When users
submit sensitive information via Skax's Web sites and
software, their information is protected both online and off-line.
At no point in time does Skax handle financial information such as credit card
numbers. Skax uses third party providers such as Paypal or Google Checkout to conduct financial processing.
All information is encrypted and is protected with the best encryption software
in the industry - SSL.
While we use SSL encryption to
protect sensitive information online, we also employ security measures to
protect user-information off-line. All of our users' information, not just the
sensitive information mentioned above, is restricted in our offices. Only
employees who need the information to perform a specific job (for example, our
billing clerks or a customer service representative) are granted access to
personally identifiable information. Finally, the servers that store personally
identifiable information are in a secure environment.
Notification of Changes
If we decide to change our privacy
policy, we will post those changes in this Privacy Policy, and other places we
deem appropriate, so our users are always aware of what information we collect,
how we use it, and under what circumstances, if any, we disclose it. We will
use information in accordance with the privacy policy under which the
information was collected.
Data Retention
The time period for which we keep information varies according to what the
information is used for. In some cases, there are legal requirements to keep
data for a minimum period. Unless there is a specific legal requirement for us
to keep the information, we will retain it for no longer than is necessary for
the purposes for which the data was collected or for which it is to be further
processed.
